What should foreigners who want to acquire real estate in Turkey pay attention to?

•Mortgage, lien, etc. on the real estate. Issues such as whether there is arestriction or whether there is any obstacle to the sale of the immovableshould be checked by the relevant Land Registry Office.

 

• Incase of rejection of the application to acquire immovable property, an appealcan be made to the Regional Directorate to which the Land Registry Directorateis affiliated.

 

• It isrecommended not to work with people or companies that are not known to beexperts and reliable.

 

• Aresidence permit is not required for the foreigner to acquire real estate inTurkey.

 

• Incase of any dispute between the parties regarding the acquisition of immovableproperty, the situation should be referred to the judicial authorities and alawsuit should be filed in the courts of the Republic of Turkey.

 

• Do Ineed a translation of the passport? Turkish translation of passports andforeign country identity documents using alphabets other than Latin alphabet isrequired by the Land Registry Directorate if deemed necessary, but Turkishtranslation of passports or country IDs issued in Latin alphabet is notrequired.

•In theapplications of foreign national real persons to the relevant land registrydirectorates for the acquisition of immovable; Foreigners whose immovableacquisitions are subject to a residence permit are required to keep theoriginal or a certified copy of the power of attorney together with theirtranslations, in case they take action by proxy on the basis of the power ofattorney issued from abroad. Before making sales contracts, matters such aswhether the immovable is registered with limited real rights, whether it ismortgaged or whether there is any situation that prevents its sale, should bechecked from the relevant Land Registry Office.
